We are moving and doing so has caused much stress.
Stress from not having enough money due to not paying last months rent when we moved in.
Stress due to the ass wipe of a real esate agent that has been showing the house during 2 hour long open houses on the weekends.
Stress to strangers stealing from the apt's while the open house is taking place.
Stress due to our lanlords trying to force us into all this illegal shit, like signing a lease even though we are leaving in 2 weeks.
she told us by law we need to sign a lease and that we have been living here illegally for the past year...Supposedly becasue we never sent in a lease for last year, a lease that we in fact did send in which included a rent rise of $50.00 a month that we had been paying this last year that we were supposedly living here "illegally"
I did some research and not only found out that nothing we did or will be doing is against the law, but that they in fact have broken some laws while we have been residing here. (not making repairs, infestation (only ants but still!) and not sending us information on interest accrued on our security deposit which shhould have been deducted from our rent the past 4 years!)
So I laid down the law......

We have a problem, we can not afford to pay this months rent and move into another apt. We also know that you can't use our security deposit without our permission to pay rent but according to MA laws it can be used upon us leaving to pay any unpaid rents. I know this not the ideal situation for either of us, but we simply do not have the money.
Also we don't want to sign a lease and are not required to under MA law. Joe had mentioned something about us not signing a lease last year, but we did and sent it back, that's how we knew our rent was being raised by $50.00 per month for the apt. If you didn't receive the lease in the mail you should have called us and asked if we had sent it. Please let us know if you didn't receive one because that would mean we were illegally paying you a $50.00 increase for the past year.
Also with the security deposit by law you should have been sending us our statements of interest that it has been accruing which we haven't received and by law should have been deducted from either our rent or added onto the deposit upon termination of our relationship.
Also we can not discuss this at out work places if you would like to call us please do so after 5:00 pm our time. Or feel free to contact us through email.

We are hearing from you that this change has been very difficult for you both, and we never intended for this to be the case. We appreciate that you have been good tenants. We are also hearing and understand that you are in a difficult financial situation.
Scott and I have talked and are willing to offer the following: we will waive July's rent and will refund your security deposit in full (with accrued interest) by July 31st. All that we ask is that you agree to move out by August 1st, 2005.
Please send me an email letting me know that you accept these terms so we can all move forward.
